1. Definitions

"Agreement" means these Terms and Conditions together with any applicable Subscription Plan description, as updated from time to time.

"soundtura" / "we" / "us" / "our" means soundtura LTD, a company incorporated in England and Wales (Company No. 14071912), trading as soundtura.

"Musician" / "you" / "your" means any individual or entity that registers for an Account on the Platform.

"Platform" means the soundtura software-as-a-service platform, accessible via soundtura.com and any associated subdomains.

"Content" means any audio tracks, photos, biographical information, genre data, social links, and any other material uploaded to or generated through the Platform by the Musician.

2. Acceptance of Terms

By creating an Account, you confirm that you have read, understood, and agree to be bound by this Agreement. If you are registering on behalf of a legal entity, you represent and warrant that you have authority to bind that entity to this Agreement.

soundtura reserves the right to update this Agreement at any time. We will notify you of material changes via email or a prominent notice within the Platform. Continued use of the Platform after the effective date of any amendment constitutes acceptance of the revised terms.

3. Nature of the Platform and Service

soundtura is a professional platform built for musicians, with the purpose of helping them build a professional profile, upload their music, and get discovered. The service includes establishing a professional online presence, managing and showcasing the Musician's tracks and profile, and connecting musicians with their audience.

soundtura will use commercially reasonable endeavours to make the Platform available 24 hours a day, 7 days a week, except for planned maintenance and events outside our reasonable control.

4. Musician Account

To use the Platform, you must complete the registration process. You agree to provide accurate, complete, and current information during registration and to keep that information up to date. You must be at least 18 years of age to create an Account.

You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Each Musician may hold only one Account.

5. Subscription Plans and Fees

The Free Plan provides access to all core Platform features at no charge, including profile creation, track uploads, and public discovery. soundtura is currently free for all users. Any changes to pricing will be communicated with at least 30 days notice.

6. Musician Content

You retain full ownership of all Content you upload to the Platform. By uploading Content, you grant soundtura a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your Content solely for the purpose of providing the Platform services.

You are solely responsible for ensuring that your Content does not infringe any third-party intellectual property rights and complies with all applicable laws.

7. Your Music and Data: What soundtura Will Never Do

soundtura will never use your tracks, photos, profile content, or any other creative work you upload to the Platform to train, fine-tune, or otherwise develop any artificial intelligence or machine learning model. soundtura will never license, sell, or make available your content to any third party for AI training or dataset creation. Your music is yours. Always.

8. Intellectual Property

All intellectual property rights in the Platform are and shall remain the exclusive property of soundtura LTD or its licensors. The soundtura name, logo, and all related marks are trademarks of soundtura LTD.

9. Warranties and Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent permitted by applicable law, soundtura disclaims all warranties, express or implied.

10. Limitation of Liability

soundtura's total aggregate liability shall not exceed the total fees paid by the Musician in the twelve months preceding the event giving rise to the claim. Nothing excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.

11. Term and Termination

The Musician may terminate this Agreement at any time by deleting their Account via Settings. soundtura may terminate or suspend the Musician's Account immediately without prior notice in cases of material breach or harm to soundtura or third parties.

12. General Provisions
